General selling conditions

- Summary of the basics shop rules.
1.1 These General Conditions govern the distance selling service of Products (hereinafter the Service), as defined below, on the website https://www.swisswatchpassion.com (hereinafter the "Site") by swisswatchpassion.com Safin Italia Srl (hereinafter the "Seller").
1.2 Before making your purchase, we invite you to read these General Conditions of Sale in full; however, we indicate below the main terms and conditions of the Service:
- Price and presentation of the products: where not expressly indicated, the prices of the Products are expressed in Euros, they include VAT and shipping costs, the images of the Products offered for sale on the site may not correspond to the real ones due to the browser Internet and monitor used.
- Purchase method: to purchase one or more Products you will have to carefully fill in and send the Seller electronically a Purchase Order (which is valid as a binding contractual proposal) which summarizes the information on the essential characteristics of each Product ordered and the relative price, the means of payment, the methods of delivery, and the shipping costs. By submitting the Purchase Order, you confirm that you know and accept the General Conditions of Sale.
- Order fulfillment: after receiving the Purchase Order, the Seller transmits confirmation of your acceptance or, possibly, indicates the reasons why your order will not be processed by refunding the amount paid by you. The shipment takes place only after the regular registration of the payment within 20 working days of receipt of the Purchase Order.
- Warranty: all the Products available on the site are guaranteed for lack of conformity manifested as required by the Italian jurisdiction. To use the warranty, you will need to keep the receipt (or invoice) that you will receive in the package, attached to the purchased product.
- Right of withdrawal: you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. On how to exercise this right, see the following articles on the return and exchange policy. Please note: customers who purchase with a VAT number cannot exercise the right of withdrawal.

- Information and product prices.
2.1 All information on the essential characteristics of the Products is provided within the identification card of each of them.
2.2 The prices of the Products are expressed in Euros and (where not expressly indicated) are always inclusive of VAT and do not include shipping costs. The prices indicated on the Site may be subject to updates, we therefore invite you to check the final sale price before submitting the relevant Purchase Order.
- Methods to conclude the purchase agreement.
3.1 To conclude the purchase contract for one or more Products on the site, after selecting the Product or Products of your interest, you must first fill in and send the Seller electronically a Purchase Order of the selected Products in electronic format (which is valid as a contractual proposal), indicating the Products you are requesting to purchase, the chosen payment method and some of your personal data necessary for delivery (hereinafter the Purchase Order).
3.2. The Purchase Order consists of a "Personal Data" screen in which you must indicate the personal data required for delivery and a screen for selecting and activating the chosen payment method (as better indicated in Article 4 below). The Purchase Order also contains a summary: information on the essential characteristics of each Product ordered and the relative price (including VAT), the means of payment available to purchase each Product, the methods of delivery of the Products, and of shipping costs.
3.3. The Purchase Order will be stored in our database for the period of time necessary to process the orders (and in any case within the terms of the law). You will be able to access your Purchase Order at any time, to monitor its status by connecting to the Site and accessing the "my orders" section.
3.5. The contract is concluded when the Seller receives and accepts, electronically, your Purchase Order, after verifying the correctness of the data relating to your order. The Seller may not execute Purchase Orders: (a) that do not give sufficient guarantees of solvency or that are incomplete or incorrect, or (b) in the event of unavailability of the Products (if they are no longer available or on sale ). In these cases, the Seller will promptly inform you (and in any case within thirty days from the day following that on which the Seller will have received your Purchase Order) by e-mail that the contract is not concluded, specifying the reasons. . If you have already paid the price of the Product and the shipping costs, you will be refunded the corresponding amount (as better indicated in article 5 below).
In the event that the Seller intends to conclude the contract, he/she will send you, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the Purchase Order.
- Payment Methods
4.1. When submitting the Purchase Order, you will be asked to choose one of the following methods of payment for the Products:
a) bank transfer made out to the Seller;
b) Credit Card (via Stripe);
4.2. In case of payment by bank transfer in advance, you will receive confirmation of the bank details on which to make the transfer by e-mail together with the purchase order receipt from the Seller.
We invite you to check the completeness and correctness of the references and essential elements of the bank transfer. Missing data or the absence of necessary references may cause delays in the fulfillment of orders and in the subsequent delivery of the Products.
4.3. In case of purchase by means of payment by credit card, at the conclusion of the procedure for completing the Purchase Order, in case of choice of payment by:
Credit Card, we will ask you to enter your card details which will be communicated in encrypted and secure mode to the Stripe servers that will manage the entire transaction;
PayPal, you will be automatically directed to the PayPal login page. In this way, the amount relating to the order will be charged to your PayPal account upon receipt of the order by the Seller.
In the event of subsequent cancellation of the order, the refunded amount will be charged to your Credit Card account depending on the payment method chosen. In no event shall the Seller be held liable for any direct or indirect damages caused by delays in the failure to release the amount committed by Stripe or by your Bank.
At no stage of the purchase procedure on the site, the Seller is able to access your financial information or to know it. Your card details are never saved on our servers.
5.Shipping and delivery of the Products
5.1. The shipment of the Products is carried out to the address indicated in the Purchase Order only after the regular registration of the payment of the relative order and upon payment of the price. No deliveries will be made to post office boxes. In any case, the Seller will ship the Products no later than 20 working days from the day of receipt of payment.
5.2. We ship Worldwide. Deliveries in Italy will be completed on average within 3 working days from the date of shipment, with the exception of Saturdays, Sundays and holidays in general. The delivery terms just indicated are to be considered purely indicative, the Seller will not be in any way responsible for any delivery delays due to causes not attributable to it.
5.3 The shipment will be accompanied by an invoice / receipt issued by the Seller.
5.4 The shipment is free in Europe and for Extra UE if you spend over €1999, otherwise is also free.
- Products quality and warranty
6.1. The Seller does not sell used Products or Products of lower quality than the corresponding standards offered on the market. You are aware and accept that the images and colors of the Products offered for sale on the site may however not correspond to the real ones due to the Internet browser and monitor used.
- Returns right
7.1. You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site.
To withdraw from the contract you must first send an e-mail to the address: email@example.com to obtain the authorization of the return and you will then have to return the Products to Via della Tecnica 18 - 85100 Potenza (PZ) delivering them to the courier for shipment within fifteen (15) working days from the date you received the Products.
You will be responsible for shipping costs, including liability in case of loss or damage to the Products.
7.2. The right of withdrawal - in addition to compliance with the terms and methods described in point 7.1 above - is understood to be exercised correctly if the following conditions are also fully met:
a) the Products must not have been used, opened, worn, washed or damaged;
b) the identification tag (if present) must still be attached to the Products;
c) the Products must be returned in intact packaging, properly sealed with packaging and contents intact, original and complete;
d) the returned Products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept Products of the same order, returned and shipped at different times.
7.3. If the right of withdrawal is exercised by following the methods and terms indicated in this paragraph 7, the Seller will refund any sums already collected for the purchase of the products.
The sums will be reimbursed as soon as possible and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures pursuant to following paragraph 8, once the correct execution of the terms and conditions indicated above has been verified.
7.4. If the methods and terms for exercising your right of withdrawal are not respected, as specified in this paragraph 7, you will not be entitled to a refund of the sums already paid to the Seller; however, you can get the Products back, at your expense, in the state in which they were returned to the Seller. Otherwise, the Seller may keep the Products, in addition to the sums already paid for their purchase.
- Times and terms of refund
8.1. After the return of the Products, the Seller will make the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 7.1. and 7.2. In the event that the checks are concluded positively, the Seller will send you, via e-mail, the relative confirmation of acceptance of the Products thus returned.
8.2. Whatever the payment method you use, the refund procedure is activated by the Seller in the shortest possible time and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verification the correct execution of your right of withdrawal and acceptance of the returned Products.
8.3. If there is no correspondence between the recipient of the Products indicated in the Purchase Order and whoever made the payment of the sums due for their purchase, the reimbursement of the sums, in case of exercise of the right of withdrawal, will be carried out by the Seller, in any case, towards the person who made the payment.
- Extreme cases
The Seller will be relieved of any contractual obligation to do or deliver and will not be required to pay any indemnity in the event of extreme events that prevent the fulfillment of obligations imposed on him, such as, but not limited to, riots, social, telephone or computer breakdowns or serious damage to the security and operation of the internet, strikes and impossibility of supplying Products and materials.
- Applicable law and dispute resolutions
10.1 The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 (Consumer Code) with specific reference to the legislation on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
- Periodic updates
The General Conditions of Sale are amended from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on the site. We therefore invite you to periodically consult this section to check for any updates.
